How Overtime Pay Works
Under the US Fair Labor Standards Act (FLSA), non-exempt employees must receive overtime pay for hours worked over 40 in a workweek at a rate of at least 1.5× their regular rate.
Some states (California, Alaska) require overtime for hours over 8 in a single day, not just 40/week. Always check your state labor laws for the exact rules that apply to you.
Overtime FAQ
Time and a half means you earn 1.5× your regular hourly rate for overtime hours. If you earn $20/hr normally, you'd earn $30/hr for each overtime hour (over 40 hrs/week under federal law).
Most salaried employees earning over $684/week ($35,568/year) are exempt from FLSA overtime rules. However, salaried workers earning below that threshold are entitled to overtime. Check with your HR department if you're unsure of your classification.
Overtime itself isn't taxed at a higher rate, but earning more money in a week may push your withholding into a higher bracket temporarily. Your overall annual effective tax rate stays the same — you'll reconcile everything when you file.
